Trade Mark Searches
It is critical that your trade mark application should start with a search for identical and similar marks and any marks that may impinge on your ability to gain a monopoly right to use your trade mark for the goods and/or services in your market.
My search service includes a search of the Australian Trade Marks Register as well as a common law trade mark search.
You will receive a Trade Mark Search Report with findings, issues and recommendations for moving forward with your application.
Trade Mark Applications
Once the preliminary searches are completed, your trade mark application can be filed with IP Australia.
Depending upon your trade mark strategy, your requirements, and the particulars of your trade mark matter, I can then assist you with filing applications for registration of your trade mark in Australia.
Your trade mark will be examined and processed through IP Australia. If your trade mark examination is successful and your trade mark is accepted without opposition, it will take upwards from approx 7 months minimum to attain registration status.
Trade Marks Talks
One of the fun things about being in business for yourself is the freedom to be your own creative boss. You’ve possibly created unique names for your brands, domain names and even your business name. But did you know that registering a business or domain name does not give you ownership of that name? Only with trade mark registration can you enforce your exclusive right to use the name for the products and services in your market.
I run short trade marks talks for business owners, brand makers and creators who want to learn about trade marks in Australia and how to protect them. If you’d like me to present to your small business group, start-up community or at your event get in touch. Let’s see if my talk is a good fit for your group.
